Legal basis

Annex 13 of the Convention on International Civil Aviation (ICAO Convention) of December 7, 1944 regulates the procedures for investigating and evaluating air accidents and disruptions to civil aircraft and defines the obligations and rights of the contracting states when working together. The Federal Republic of Germany acceded to the agreement on April 7, 1956 (Federal Law Gazette II 1956, page 411). According to Art. 37, 38 of the agreement, the member states are obliged to implement the requirements of the annexes.

In order to implement Annex 13 into German law, the Law on the Investigation of Accidents and Incidents in the Operation of Civil Aircraft (FlUUG) came into force on September 1, 1998. It replaced a previously applicable general administrative regulation for the technical investigation of flight accidents during the operation of aircraft. The FlUUG regulates the requirements for the work of the Federal Bureau of Aircraft Accident Investigation at national and international level.

The FlUUG is supplemented or partially replaced by Regulation (EU) No. 996/2010 of the European Parliament and Council of October 20, 2010. This regulation on the investigation and prevention of accidents and incidents in civil aviation repeals Directive 94/ 56 EC and came into force on December 2, 2010. With this regulation, the EU implemented the requirements of Annex 13 for the scope of its member states. In relation to the FlUUG, Regulation (EU) No. 996/2010 is to be applied with priority.
