Data Protection

On 25 May 2018 the General Data Protection Regulation (GDPR), Regulation (EU) No. 2016/679, has become effective. As with all EU regulations it has become directly enforceable law. In addition the Federal Protection Act (Act to Adapt Data Protection Law to Regulation (EU) 2016/679 and to implement Directive (EU) 2016/680) has become effective for parts of the regulation which allow or necessitate national regulations.

Both regulations contain information which, in accordance with Article 12 GDPR, has to be provided to individuals when personal data is processed. All public authorities and non-corporate companies processing personal data are required in accordance with Articles 13 and 14 GDPR to provide such information.

The BFU implemented these requirements as follows:

The Data Protection Statement applies to all personal data which is processed during access of the website, receiving the newsletter or use of the contact form as well as to other data protection or liability notes.

The Data Protection Notice applies to information regarding the personal data which is processed in case of an investigation.

Both publications include information regarding the respective legal basis for data processing, the rights of the data subject, and the data protection officer.

2. Collection and recording of personal data and nature and purpose of their use

a) When visiting the website

When visiting the BFU website www.bfu-web.de the browser you use on your device automatically sends information to the server of our website. This information is temporarily stored in a so-called log-file. The following information is recorded and stored until automatically deleted.

    The anonymised IP-address

    The anonymised IP-address (the IP-address of the accessing host system is exclusively stored as: the last two bytes of the address are set to 00; e.g. xxx.xxx.0.0)

    The browser

    The protocol

    The systems software, which the accessing person uses

    The website from which the BFU websites were accessed

    The BFU websites visited

    A potential error code of the enquiry

    The transferred data volume

    The time of the visit

This data is exclusively analysed for statistical purposes and the improvement of the internet service and then deleted. This data is not combined with any other data. The data is not used for any other purposes and not transferred to third parties. Data, which was recorded through the internet access, is only transferred to third parties if the BFU is legally or by court order obliged to do so or if the transferal is required for prosecution purposes due to internet infrastructure attacks. There is no other transferal for non-commercial or commercial purposes.

Legal basis for data processing is the General Data Protection Regulation (GDPR) Art 6 para 1 S 1 lit. f. Our legitimate interest results from the purposes listed above for data processing. In no case do we use your data to draw conclusions as to your person.

b) Registration for our Newsletter

If you explicitly agreed in accordance with GDPR Art 6 para 1 S. 1 lit. a we will use your e-mail address solely to regularly send you our newsletter. To receive the newsletter it is sufficient to state your e-mail address.

c) Using our Contact Form / the Online Reporting Form

If you have any questions you may contact us via the form provided at our website. Stating your e-mail address is required so that we know who has sent the enquiry and can answer it. All other contact information is voluntary.

Data processing for the purpose of establishing contact with us occurs in accordance with GDPR Art 6 para 1 S 1 lit. a based on your voluntarily given consent.

The personal data collected for the purpose of processing your enquiry will be automatically deleted as soon as the task is finished.

In case of an online reporting of an occurrence we provide the online reporting form at our website. The BFU processes the data solely for the purpose of the responsibilities of public administration to investigate accidents and incidents in accordance with Regulation (EU) No 996/2010 of the European Parliament and of the Council of 20 October 2010 on the Investigation and Prevention of Accidents and Incidents in Civil Aviation and the Law Relating to the Investigation into Accidents and Incidents Associated with the Operation of Civil Aircraft (FlUUG). These regulations also regulate the period for which the personal and other necessary data transmitted as part of the online reporting form, will be stored.

3. Transfer of data

There is no transfer of personal data to third parties, except for the purposes listed below.

We shall transfer data to third parties, if:

· The transferal occurs because of legally permissible purposes and the benefit of a transferal of the documentation listed in Regulation (EC) No. 996/2010 Art 14 para 1 and 2 for this legally permissible purpose predominates the adverse national and international effects, which such disclosure may have for this and future safety investigations (Regulation (EU) No 996/2010 Art 14 para 3, para 25 Act to Adapt Data Protection Law to Regulation (EU) 2016/679 and to Implement Directive (EU) 2016/680, GDPR Art 6 para 2 and 3).

· You have given express consent in accordance with para 21 FlUUG , or GDPR Art 6 para 1 S. 1 lit a

4. Rights of the data subject

You have the right:

· In accordance with GDPR Art 16 to request the rectification of inaccurate data or the completion of your personal data stored by us;

· In accordance with GDPR Art. 20 to receive your personal data, which you have provided, in a structured, current, and machine-readable format, or to request the transferral to another responsible person/authority;

· In accordance with GDPR Art 7 para 3 to withdraw your consent at any time. The withdrawal of consent shall not affect the lawfulness of processing based on consent before its withdrawal;

· In accordance with GDPR Art 77 to lodge a complaint with a supervisory body. Normally you may contact the supervisory body at your habitual residence or place of work or the place of business of the BFU.

The right of access, deletion, processing restriction, and objection in accordance with GDPR Art 15, 17, 18, and 21 only exist provided that they are not excluded by paras 34 to 36 Act to Adapt Data Protection Law to Regulation (EU) 2016/679 and to Implement Directive (EU) 2016/680.

5. Data security

The BFU website uses the Secure Socket Layer (SSL) procedure in combination with the highest encryption level your browser supports. The status bar of your browser shows a locked key or lock if an individual page of our website is transferred encrypted.

We are using appropriate technical and organisational safety mechanisms to safeguard your data against random or deliberate manipulations, partial or complete loss, destruction, or unauthorised access by third parties. Our safety measures are continuously improved in accordance with the technological development.

6. Other references concerning data protection and liability

Links to websites of other providers

On our website we provide links to other providers. The BFU is not responsible for the content of those websites. The links have been carefully selected and the contents checked before the initial link-up. Links have dynamic characteristics. This means that the content of the linked websites might have been changed without knowledge of the BFU. Continuous testing of the contents never was and is intended or possible by the BFU. The BFU expressly distances itself from any content that may infringe criminal or liability law or that is contra bonos mores.

Only the provider of another website, to which we provide a link, will take responsibility for any damages which resulted from the use or non-use of this other website.
